Penang to ban homestay

The Penang state government will implement the guidelines for prohibiting short-term rentals (homestays).

State Housing, Local Government, Town and Country Planning Committee chairman Jagdeep Singh Deo said he will present the proposal to the state executive council and the state government will announce the details later.

“We do not want a situation where it will disturb the well-being of other residents. People do not want their house to become a hotel. That’s the simple reasoning behind the guideline”

Jagdeep made the above remarks when handing over the Hari Raya aid to the city hall staff outside the Penang Island City Hall Building on Tuesday morning.

He said that once the ban on short-term rental of high-rise units is implemented, Penang will become the first state in the country to implement such policy.

Does not affect long-term rental

He said that this does not affect the long-term rental of high-rise residential units; the state government does not allow high-rise units that are used for residential purposes to be “hotels”.

“There are so many hotels in the state, those looking for short-term rentals should have plenty of accommodation.”

Jagdeep said that the state government also does not allow short-term rental of landed houses. Although there will be no real law enforcement for the time being, the authorities are monitoring the situation and will start to study how to control it.

    Stupid lahhh. Homestays are for large families who cannot afford hotels. Now poor people cannot travel anymore and homeowners are going to lose out on business.

      So be it if the homeowners cannot rent out to homestayers.
      It’s the wrong thing to do in a fully residential area.
      We care more of our peace of mind that inconsiderate home owners who rent out their homes to noisy homestayers who make noise all throughout the night

      Hi Bro wait till u leave beside homestay/Airbnb then u will know how torturous are these party animals affecting your health due to tremendous stress
      If poor people want to holiday please go to budget hotels but not in residential areas where people’s home are. Please be considerate. T u

    No AirBnB should allow in the condo or apartment , this will not be good for hotels and further more short term stay will put current condo occupant / tenant in danger for security reason.. support the states government No AirBnb for condo …

    Aiya you think the ban can easily be implemented in Msia meh? In order to ban effectively, you need enforcers from MO to check constantly. In Msia, ppl from MO are normally lazy, not to mention easily bribable. So this only creates lobang for them only lah, you earn, I earn, everybody together earn loh.

    Holiday makers are welcome to holiday in hotels, but not to be a disturbance to residents in neighborhoods. Batu Ferringhi Residents Association does not welcome noisy and illegal homestays in our neighborhood.

    Homestayers who come in large groups into our quiet neighbourhoods and make so much noise throughout the night n into the wee hours of the mornings are nothing but pests, inconsiderate idiots and an a great annoyance.
    You are definitely not welcomed into our neighbourhood.
    Get out & stay out of our peaceful neighbourhoods and please just go stay at our beach hotels.
    Homestayers in residential areas are just wrong

    One will never understand if they don’t live around homestays/Airbnb premises, we are telling the truth, nothing more than the truth, our 4 years of tormenting experience caused by the irresponsible, uncivilised barbaric behaviour of the homestayers destroying our peaceful living environment.
    So please lah, enjoy your holidays in hotels or budget hotels in commercial areas and not in residential areas where people’s homes are. T u

    1. either one is ok provided there are adequate guidelines & controls & resources in place to ensure fairness to all stakeholders.
    2. IF allowed, a proper guidelines on dos & don’ts to be observed & monitored.
    3. If NOT allowed, a proper guidelines & monitoring need to withstand those who circumventing the ‘law/act’. E.g., they say it’s their relatives and etc etc who stay, also security issues etc etc.
    4. My take, to ban it is better, less troublesome and cost effective as less efforts-energy, time & money got sucked into it.

    Only residential title lah, tak kan a hotel with commercial title also cannot do short term stay kah? Also, please take note, although short term stays are banned in residential units (by default), if more than 75% of the owners in any condo project are AirBnB hosts, and they all come vote in an EGM to allow AirBnB, then it will be allowed too, as long as it’s being operated within the guidelines.

    Don’t just talk. Make sure you enforce the ban of short term rentals. Like the LMC apartment which are meant for homeowners to stay only, now is 80% rented to foreigners. Government like to talk only, no action.

    Those who complain about this ban is just pure deepshits. We buy house to stay, not to make money and cause annoyance to neighbors. No money to holiday then don’t holiday. Don’t go do party YOLO-style since you won’t be taken action as soon as you move out the next day causing disastrous noise the night before.

    Those project under commercial title with majority vote agreed for homestay in AGM then no problem.
    Those ban only applicable for pure residential title project after AGM been called & vote by majority owners.
    Example like Straits Garden Suites/Maritime/Tropicana Macalister 218 shouldn’t be an issue in homestay as majority owners bought for homestay activities used. It’s up to owners to decide in AGM respectively & bring up to court.
    That’s no law currently in Malaysia called for homestay prohibited yet even for residential project. For new residential property, after CCC then need to form an proactive committee to call AGM as soon as possible if to avoid their condo become next homestay nest. Even owners running a homestay business in residential project that’s nothing wrong until AGM called & majority vow record & brought up to court to enforce. Take note guys. Just sharing.

    What is the time frame for short-term vs. long-term rental? For example, would 30 days (1 month) be considered short-term? I am planning to visit Penang in later 2022 or early 2023 and stay for up to 3 months but would rather rent an Airbnb apartment/condo than stay at a hotel.

    Go ahead for Airbnb then no problem.
    If normal condo then you may have some problem as access in & out all need get approval from management with the proof of tenancy agreement signed. It’s depend on how management to control.

    In Spore, a lease term of at least 3 months will be considered long term. I am not sure what PG gov would be imposing, To be safe, try looking at only commercial titled properties, and not residential titled properties. I believe AirBnB should have that piece of info attached to any properties listed in PG, given the impending regulation. If not, then AirBnB is really lousy.

    Commercial Office are for office because as built plans already stated Managers Room, Pantry etc etc just exactly like an office .
    Commercial title can be spread around to Commercial Offices, Commercial Suites, Service Apartments, SOHO, SOFO, SOLO just to name a few.
    Exco wanna do something, regulate as simple as Commercial Titles Like Service Apartments, SOHO as permitted short term rentals.
    Exco should look into matters like whether Commercial Offices or Suites are meant to be done as offices, or as a residential living space. Then should go for an AGM to call upon if permitted to do short term rental. Grey area indeed.
    Pros and Cons of commercial titles all the while.

    Urban Suites and Macalisterz 22 are sold and mentioned can be done as Airbnb/Short Term Rental, buyers bought already then say cannot do airbnb/Short Term Rental ? Masi Gai also leh ?

    COB almost useless one to complain. They just approve developers’ building stuffs and maintenance rates. After that, tak peduli dah.

    The flow goes this way.

    You contact Perumahan, they suggest check with Management. Then check with management, they say need check with developer. When checked with Developer, it is not their business anymore. Then you inform perumahan the situation. Then you check with COB. They will ask you to check with MBPP. Then MBPP will ask you to check with Perumahan. Once you lodge an official report/complaint to LPNPP/Perumahan. They will inform you that there is no clause forbidding such and such. Feel free to contact them for more information. The moment you call Perumahan for clarification, they can just ignore you and close the call. Ultimately, nothing we can do. They don’t have KPI whatsoever for issue solved, so they just makan gaji and enjoy government benefits. Our income tax are meant for them.
