Penang govt to resubmit EIA for PSR project

The Penang State Government will resubmit the environmental impact assessment (EIA) report for the Penang South Reclamation (PSR) project to the Department of Environment (DOE), says State Infrastructure and Transport Committee chairman Zairil Khir Johari.

He said the project was for the state’s economic recovery post-COVID-19, and he hoped it could be implemented for the benefit of the people.

“Apart from that, the State Executive Council which convened yesterday, has agreed to take legal action by filing a judicial review on the decision of the DOE Appeals Board, (as) it resulted in the revocation of the EIA approval for the PSR.

He said the state government took note that the decision was only based on non-compliance with the planning process, and not on substantive arguments or ‘merits of the case’.

Zairil said according to the written decision of the Appeals Board, the EIA report was found not to have met the requirements of Section 34A (4) (a) of the Environmental Quality Act 1974, because the Penang State Structure Plan 2030 (RSN2030) was not yet in force when the EIA approval was given.

He said the state government did not agree with the decision of the Appeals Board, and was of the opinion that all planning processes and procedures and necessary approvals had been complied with, including the approval of RSN2030 by the State Authority through the State Planning Committee (SPC) on March 14, 2019 and subsequent tabling to the National Physical Planning Council (NPPC) on April 18, 2019.

“Both compliances are deemed sufficient for the requirements of Section 34A (4) (a) which stipulates that the project must be in line with the ‘development plan or physical plan approved by the relevant approving authority’.

“Therefore, the approval given by the DOE director-general on June 15, 2019 does not conflict at all with the requirements of the Act,” he said.

On Sept 8, three members of the DOE Appeals Board led by Sessions Court judge Rozina Ayob set aside the EIA approval for the project. Two other members of the board are Prof Datuk Dr Mazlin Mokhtar and Associate Professor Dr Ramdzani Abdullah.

The decision was made following an appeal filed by Sungai Batu Fishermen Unit chief Zakaria Ismail, on July 29, 2019, under Section 35 (1) (e) of the Environmental Quality Act.

The PSR project covering 17 sq km involves the development of three man-made islands covering an area of 1,700 hectares in the waters off Permatang Damar Laut, near Bayan Lepas. which was introduced as a funding module of the Penang Transport Master Plan (PTMP) worth about RM46 billion.

Four outdoor attractions in Penang may open on a trial basis

Penang has proposed a test run for the reopening of spacious outdoor tourist attractions in the state before embracing the full resumption of travel activities, says state executive councillor for Tourism and Creative Economy Yeoh Soon Hin.

Yeoh, in a statement yesterday, said the test run is aimed at fine-tuning and improving health protocols at tourist attractions, and will be conducted in collaboration with Association of Tourists Attractions Penang (ATAP) at outdoor attractions with ample space.

“We have tentatively identified four outdoor attractions in Penang which will be involved in this test run. They are The Habitat, Tropical Spice Garden, Penang Tropical Fruit Farm and Penang Bird Park,” he added.

The Penang government, Yeoh said, had submitted the proposal to the National Security Council after an online meeting with ATAP. It was also attended by Chief Minister Chow Kon Yeow.

He explained that the four attractions were selected as part of the test run because they have wide spaces that are aligned with health protocols, that subsequently allow social distancing and good air ventilation, effectively avoiding overcrowding issues.

He added that the test run will be conducted with strict adherence to health protocols which will limit the test run to three days per week, only applicable to fully vaccinated visitors who have pre-booked their tickets online prior to the visit.

“The visitors for each attraction will also be capped at 30 persons at any one time and will be required to strictly comply with the standard operating procedures (SOP). The tourist attraction operators will also have to work closely with the police authorities which will be monitoring this test-run.

“In fact, the tourist attraction operators have strictly complied with the SOPs ever since the pandemic outbreak. Even now when other sectors have been permitted to reopen, it is a shame that they are still patiently waiting for their green light. The prolonged closure is taking a toll on the industry players’ livelihood,” he added.

Foreign workers should be provided specific housing needs

State executive councillor Jagdeep Singh Deo has proposed to the Federal Government to prohibit foreigners and locals from rental of low-cost and low medium-cost housing schemes as well as to enact legislation regarding urban regeneration.

He said he was very happy that Housing and Local Government Minister Datuk Seri Reezal Merican Naina Merican was receptive to his proposals when they had a meeting yesterday.

Jagdeep said specific housing needs like hostels should also be provided for foreigners, who reside in low-cost and low medium-cost schemes.

“We have seen many problems arising when the foreigners stay in many of our housing schemes. In fact, 70 percent of the Covid-19 clusters in the state are from factories and the majority of them are from foreigners. It’s very unfortunate, I have nothing against them.

“But we want to take care of them. We have to provide specific housing for them so that the infection will not spread,” Jagdeep told a press conference in Komtar today. It was also carried live via his Facebook page.

Thus far, he said Penang has 11 housing schemes accommodating 70,000 foreigners.

“If we see many foreigners in many of our housing schemes, we should look at our laws to disallow them from staying there.

“At the moment it is a federal law which needs federal intervention whereby an amendment can be made to prohibit rental of low-cost and low medium-cost housing not just to foreigners but also locals.

“This is our desire in Penang. We want to ensure they are owner occupied. I have said this before and he (Reezal Merican) agreed with me,” Jagdeep added.

He said he had suggested to the ministry to look into a new enactment to deal with urban regeneration after learning that some 12 legislations, guidelines and regulations have to be amended during his discussion with Reezal Merican and his officers at the meeting.

“To amend the 12 legislations, guidelines and guidelines that involve for instance National Land
Code will take a long time. We have already suggested that there should be a specific law enacted for urban regeneration and Datuk Seri Reezal has told his officers to study the proposal.

“I think this is amazing. We need to move forward and quickly. It is nothing new; others like Singapore, Hong Kong and Australia have done so. To enact this new law is not only for Penang but for all states,” he added.

Jagdeep thanked Reezal Merican for giving him and his team a warm welcome, describing their meeting as “comfortable” which he said augurs well for a good working relationship between the state and federal governments.

In their discussion, Jagdeep said he has also sought Federal financial assistance for the maintenance of eligible public and private housing schemes. He revealed that the state has received some RM50 million from the Federal Government and that he expected more for the coming year.

He said from 2008 until August 2021, the Penang government has spent a total of nearly RM282 million on the maintenance works of these stratified buildings.

Other than that, Jagdeep said he had also informed Reezal Merican on Penang’s need for more PPR (low-cost) units where so far only 999 units had been built in the state as well as Penang’s target to build 220,000 affordable homes by 2030 in line with the Penang2030 vision.

Also present at the press conference were the Penang Housing Board general manager Ainul Fadhilah Samsudi and Penang State Secretariat office head of local government division Nur Aishah Md Norodin.
