    Sold out but half dead? That could mean 2 things :-

    (a) Really sold out, but the deposit collected + developer’s own money is not enough to start work because developer has been giving “rebates”. So the nett deposit collected is maybe only 2% of purchase price.
    (b) Not really sold out, with a big bulk of units “bought” by developer itself. So they are still trying to push their units quietly.

    So at least they’d have to wait for the completion of eh…what’s the name of the condo beside The Peak and the grevyard…to free up some cash to start work for The Wave.

    Ivory is a pariah developer, don’t expect much. City Residence buyers waited for 5 years from initial deposit placing, with rounds and rounds of layout+unit size+pricing revision before work can finally start.

    Although The Wave was marketed as an award winning building, the award is actually based on only paper design. In other words, they are just trying to build a car that “looks” like a mercedes but using proton material. Again, the award it won can easily be”bought”.

    Now smallest unit 1270sqf start from RM1.1M above already.. Penth house 1.5M above… If u want buy 1.3M for penth house can refer to phase1&2… Even the normal unit for phase 1&2 already at RM700k+ to RM850k..

    Foreigners won’t be interested too because the location is neither here nor there. It’s not in the heritage zone, and yet not in modern upper class area. But ivory has no choice but to keep bulldozing ahead.

    Got alot of foreigner japan&Korea staying at phase1&2..Latest transaction at phase 1 is RM730k high floor fully furnish.. Phase 2 birch regency seen smaller in unit size.. Seen like the entrance of phase 2 is at the behimd..

    20 percent of the units still available. Most of it on the inside facing units. Smallest unit start from 1300 sqft. price at 1.07M and above. Just visited Ivory PTS office. The mall indeed is dead for now.

    To all owner or investor that is buying “The Wave @ Penang Times Square” as a resident to stay please take note that the wave is a service apartment people are able to do Short Term Rental (1 or 2 days rent) if you are buying for owe stay please take this issue into account, for investor that are investing to do Short Term Rental please take note that currently Ivory have implemented finger print scanner on previous project Birch Regency Penang Times Square(Service Apartment) mainly to prevent people from doing Short Term Rental.

    I mean by default it should be allow as is a service residence/apartment like birch regency but once is fully sold the JMB / JMC might try to stop it just like what is happening at Birch Regency and Plaza Penang Times Square, Penang Times Square is like IJM Maritime, you can easily search online for Maritime Waterfront Hotel, is totally converted, so resident there who bought for own stay might have problem.

    This is a tricky situation, but base on the fundamental, by law, who has the say?

    For property under commercial title, one should have the right to use the unit for office purpose. However, JMB or MC thinks otherwise, as most probably the majority of the owners are looing for own staying, or only residential renting.

    For Penang Times Square Birch Regency or Plaza as I know it is commercial land title and the apartment above falls under service residential/apartment, as I have get to know the situation at Birch Regency Penang Times Square the JMC and JMB is introducing a purely finger print system and asking owners and tenants to register their print to access and disabling all the access cards, now I wonder if this is legal by forcing the owner to register their finger print.

    Birch regency and birch plaza are residential title. All the electric, water and cukai pintu are residential rate. So the home stay or short term are non allow in all the residential title. The JMC and JMB have the right to sue the owner that run the home stay. It just like the JMC of gurney park are successful to sue the owner running home stay to the court. Finger print are a good move in furture because access card can duplicate but everyone are having difference print. It protect safety of the residents.

    Oh is it you must be one of the residents there that are buying the wrong property or are of knowledge of what are you talking but may be I am the one that is wrong, but to my knowledge there is a Vacation Club House running on Birch the Plaza know as easturia http://www.easturia.com.my/ own by the Sarawak Government, if you go to the website you will see PTS advertisement inside there and why I am not seeing the so call JMC/JMB sue this company? can you please explain the situation?
    If you cannot explain that it mean because it is own by a Government that why your JMC/JMB are scare of suing them?

    And to my knowledge Gurney Park is residential so you will see a big red signboard saying that no Service Apartment guest are allow, if Penang Times Square are residential please ask the JMC/JMB to put this notice up.

    That is only happen on the phase 1 birch plaza. But phase 2 birch regency are so far ok. I think only phase 2 are apply the thumb print so far.

    At Penang Time Square Phase 1, a lot of home stay guests jumping inside the swimming pool without showering and wearing the proper swimming attire. There was even stools in the pool. Too many outsiders coming for a swim, contaminating the water. I went for a swim at the invitation of my friend but i quickly got up when i saw a group of people swimming wearing t-shirts and tight shorts or just shorts jumped inside. What can we say???

    I used to come back to Penang and stayed at my parent home (Birch Regency). Initially the residents there have no objection to homestay. They are just worry about the future when the homestay operators become too greedy and go out of control. The homestay operators should operate at a low profile level. Not too many units. Must restrict the number of guests per units. They should not provide too many beds or mattress in one unit. It must be a win-win situation. Owners who rent out the unit to homestay operator will get their money. Residents living there will not be disturbed as the number of guests per unit are low.

    There should be a restriction on the numbers of guest in one unit. I believe there are law on this. The homestay operators should think of the residents too and not just $$$. All will have a WIN – WIN solution.

    Nothing yet. Wave plan have been rejected on May 2015. Ivory will have to submit new plan for MPPP to approve. Still a long way to go. Heard that Phase 4 have been cancelled and money have returned to buyers. Heard that a local company have bought up phase 4. Hotel coming soon ….
    Good to have a hotel there. More small hotels will also be coming up around PTS. Along Dato Keramat Road.

    Korean shoplots are coming to phase 2 by end of the year. Korean will take over all the lots in phase 2.

    Not true. Pelan Bangunan for The Wave has been approved in Dec’14. I am not sure whether the APDL is obtained, but I have seen the advertisements in property magazines and newspaper, e.g. The Star. Also, construction has started, and has disbursed the first 15% from buyers and banks few months back.

    As for The Central, I have no clue. However if this is true, we should have seen comments from those who have booked a unit. So far no single news, so quite hard to believe.

    Be careful when you purchase Wave. If you intend to use it as a service apartment/homestay, check with the MPPP first. Ivory stated ‘SERVICE APARTMENT’ in S&P. You need to get approval from MPPP first. For MPPP, they want the whole apartment to be operated as a service apartment and no just a few units at these level and a few units at the other level. The whole apartment must be managed by one service apartment management company and not a few.

    MPPP require two car park per unit too.

    If you don’t have the licence from MPPP, then you are ILLEGAL.

    Usually during the first two years after the OC, illegal service apartment/ homestay can get good profit but after the 3 year most residents will move in and the illegal service apartment /homestay will face problem. They will need to move to another new apartment.

    Phase 2 have started the renovation. You can see wall torn down. Tiles on the floor been replaced. Very dusty at Phase 2. Korean are coming. All the shoplots have been take up by korean investor. It look like phase 2 will be much better than phase 1 soon.

    By Jan 2016, Penang Times Square will be totally different. No more empty mall.

    It is expected that more Koreans will be renting the residential apartment above.

    If you don’t believed me, go there and see it yourself.

    Take the lift next to Soju and go up to level 2,3. Go to the ground floor too.

    With the LRT and tram project, property’s price at Birch Regency/Birch the plaza residential will soar

    As for the WAVE, it will still be a long time to go. No progress yet. You can see it yourself if you go up the carpark at level 4A and 4D. I predict Wave will only start Jan 2016. It will be completed in late 2019.

    Technically speaking, the location is somehow good. Good in the sense that it is near the heritage town, so that’s for tourism. Whereas the location is not suitable for residential due to various reasons. However, tourism in penang is not that hot anymore. Most tourists are disappointed with what they can find here, amid all the initial hype.

    Various so-called “attractions” in georgetown are pathetically setup, they look fake, do not represent our local culture, and lack substance. Many tourists shake their heads seeing them. So tourism is loosing it’s momentum. So with tourist arrivals dwindling, an oversupply of tourist accommodation such as the Wave is imminent.

    I am worried that since price had increased nearly 50%, developer only collected 15% money,if they default, next developer (in new name ) can make more money. Is that why the delays?

    Finally we can see a lot of shoplots opening at phase 2. Very nice mall. Totally different from other mall. Good to have new idea. As for those who want to buy the wave, better buy phase 1 or phase 2 which are completed. Current slow market condition enable us to purchase it at lower price than Wave. Wave just started pilling and still a long way to go.

    The wave will completed in 3year time from now & sure is RM1M above. This project is target for foreign buyer investor.. Not for local. And phase 1& 2 for sure will increase too…due to Same location..town area.
    Don’t say this is cold spot..as town area will never been.. M summit project& the central almost sold out.. And our georgetown prewar house more than 100 unit already bought& sold to singaporean..

    Singaporean bought a lot.. Not only The wave..more than 100+ unit pre war house arpund this area also bought by singaporean.. Those property is for foreigner market. 1M above..
    Phase 1 &2 price will up gradually this coming 3 years too..due to similar location in georgetown..

    Yes..we are understand u are not interested. Acknowleged. Noted.. No need keep on comment with no fact. U are just making fool on yourself.. We know what product we are buying.. We knew it. But u are never known because you are stand& stare..End up with comment comment bad… Non of property is perfect. It is depend on how u judge &need.

    Good new for homesharing operator. Wave is truly a service apartment. Fully commercial. Water and electricity all commercial rate. Bad new for future residents. Only phase 1 and 2 are residential.

    GEORGE TOWN: Local authorities have sprung into action and homestay operators found operating without licence have been fined.

    In a spot check by officials from four departments of the Penang Island City Council (MBPP), four unit owners in Birch Regency Condominium in Datuk Keramat were fined RM250 each for operating a business without licence.

    They knocked on the doors of 15 units believed to be available for rent on a short-term basis and found four being occupied yesterday – two units by Singaporeans, one by Australians and another by Canadians.

    “The officers spoke with the foreigners who confirmed they were here on holiday. We explained that this was a residential block not meant to be treated like a hotel or service apartment and they understood,” said Tanjung MP Ng Wei Aik who took part in the checks.

    But one of the unit owners waited outside to have his say after Ng’s press conference at the condominium block.

    “I don’t run an illegal homestay. I am earning rental from my unit here and it is my legal right. Please don’t say I am doing something illegal,” retiree Ch’ng Kim Teck, 50, who waited by the condominium swimming pool, told the press.

    Ch’ng said there were no laws to forbid condominium unit or apartment owners from renting out their units for any length of time.

    He added that MBPP’s Commis­sioner of Buildings (COB) had confirmed in a letter dated April 12 that the Joint Management Body (JMB) had no right to set a rule that unit owners could not rent out their properties for under six months.

    “The COB confirmed that we only need to inform the JMB that our units have been rented out and once that is done, all the rights to use the condo facilities are transferred to the tenants,” he said.

    Ch’ng claimed that to restrict access to the condo facilities such as the swimming pool, the JMB set up fingerprint scanners so that only long-term residents whose fingerprints are recorded could use it.

    “They made all the residents have their fingerprints recorded but we wrote to the police who confirmed to us that only certain enforcement authorities and banks are allowed to collect our fingerprints,” he said.

    He added that he and other hosts had filed a complaint with the Stra­ta Management Tribunal against their JMB.

    Three of the JMB committee members, who were present in the press conference with Ng, said they were only doing their duties as elected members.

    “We get many complaints from our fellow residents about these short-stay guests. We’re just doing our duties to protect the peace of our condominium,” said a committee member who only wanted to be known as Raymond.

    Wave buyers. If you are buying it to stay there, good luck. You will see a lot of strangers in and out. Carrying big luggages. Lifts will alway full. Noises at night. Tom, dick and harry pass by your units. No peace. You need to involved to protest but it is a commercial apartment. Surely you will lose. Maintainance fee 25 sen. Phase 1 and 2 just 20 sen. All commercial rate.

    In its recent check by officers the council’s Commissioner of Buildings (COB), as well as two MBPP departments – Licensing Department and Building Department – three unit owners in Birch The Plaza Condominium in Datuk Keramat Road were fined RM250 each for operating a business without licence.

    Tanjong MP Ng Wei Aik, who was also present during the checks, said the officers knocked on the doors of the eight units that were believed to be available for short-term rent but only guests from three units answered.

    “In the first unit, the guests were from Jakarta who were staying for three nights, the second unit was a guest from Kuching, who was also staying for three nights while two women from Belgium were staying in the third unit,” he told a press conference

    Ng said there were 417 condominium units at Birch The Plaza and it was found that 50 units were involved in the illegal lodging house business.

    “Based on all the information given by the management, the MBPP is going to issue 50 notices to the respective owners.

    “MBPP issued RM250 compound to each of the three units where we met the guests. This issue has been haunting MBPP the last two years,” he said.

    Ng said MBPP issued the summonses under the 1991 MPPP bylaw for Trade, Business and Industries for the offence of operating a business without licence.

    “Errant operators who don’t want to cease operations can be taken to court. On conviction, they can be fined a maximum of up to RM2,000, imprisonment of up to one year, or both.

    Ng said only serviced apartments are allowed to operate homestays or short stays.

    “All residential apartments, condominiums, flats and the gated residential houses are not allowed to carry out these lodging houses business,” he said.

    This project is dead. Inflation is high all material cost higher. Did you think developer can complete the project with 5 star luxury condo. I afraid all cut cost & drop to 2 star condo later.
    No money for them to complete also.

    No problem. Why not ok? The design & curve by Ivory are unique & require more time to complete & everything need to do in details. It’s tedious job.

    Just walked around the area last week, sadly the condo is kind of abandoned. No work in progress even though most of the facade is done. Hopefully there is alternative way to take over it like Queesbay last time.
